Release of Liability & Terms of Service

Please read the following carefully before agreeing.

Release of Liability

By clicking "I have read and agreed to the terms above," you agree that, in consideration of your enrollment in pet care services provided by Pack Adventures, you voluntarily release and waive any legal right to recover medical expenses, property damage, or bodily injury damages. This release applies to any injury you or your dog may sustain, as well as any damage to your property, occurring within the context of the services provided by the above-named organization.

You also agree to release and waive any right to hold Pack Adventures, their volunteers, mentees, contractors or employees liable for injuries or damage to yourself, your property, and your dog. Furthermore, you acknowledge that you are assuming the risk of your dog's participation in an environment in which dogs with unknown temperaments may be present. You accept full responsibility for injury, damage, death, or loss, and you waive any legal claim to pursue compensation for such damages, and all costs associated therewith, including attorney's fees, court costs and consultant fees arising from my participation in training or other related activities. By signing, you assume, without reservation, all risks associated with your participation in enrichment outings or other activities with Pack Adventures, including but not limited to: the risks of any and all injuries to yourself, your dog, and any of your family members or third parties; the risks that your dog may cause injury to other persons and/or dogs; the risk that your dog could escape or become lost; and the risk of damage or loss to your personal property.

You acknowledge that you have been informed and understand that there is always some unavoidable risk of injury involved in outdoor activities with dogs. You acknowledge that outings take place at 3rd-party locations which are outside of Pack Adventures' control, and that not all destinations are fully fenced. Hazards may include wildlife, other dogs, escape, weather/temperature, environmental hazards, plants, parasites, overexertion, or injury during handling/transport. You acknowledge that dogs can be inherently difficult to control and that not all dogs will be under control at all times. You understand that it is your responsibility to follow your veterinarian's guidance regarding exercise, temperature, parasite prevention, and other health/safety measures. Pack Adventures is not responsible for pre-existing medical or behavioral conditions that may be aggravated during services.

Pack Adventures makes no representations, guarantees, promises (implied or expressed) regarding any training and socialization which may be provided. The success of any training or behavior modification program is dependent upon several factors, including, but not limited to; the amount of time you spend working with your dog, how thoroughly you implement said training, the previous history and experiences of the dog, the dog's genetics, and the socialization of your dog. Training or behavior modification is not a cure, but a life-long plan. Regardless of the training and socialization received, any dog is always capable of aggression. By agreeing to these terms, you acknowledge that you have communicated all behavioral tendencies of your dog(s) to the best of your ability, including history of aggression or biting.

Pack Adventures is a door-to-door pickup/dropoff service. You are responsible for ensuring your dog is ready for pickup, including ensuring that Pack Adventures staff has safe, prompt access to your home if agreed upon. Dogs who show aggression to entering visitors must be safely contained. You agree to hold Pack Adventures harmless for any damage or loss to personal property that may occur as a result of normal entry/exit. Pack Adventures is not responsible for damage to or loss of personal items sent with your dog, including leashes and harnesses.

Session expectations are set for your safety and the safety of those around you. By signing, you agree to abide by all rules and guidelines to the best of your ability. Violating the rules may result in removal from sessions or activities at the discretion of Pack Adventures staff with partial or no refund/compensation issued.

By agreeing to these terms, you acknowledge that you have read and fully understand that this contract serves as a waiver and release of liability for any injury, damage, or loss involving yourself, your dog(s), or your property. You also certify that you are over the age of 21, sober, and of sound mind.

Terms of Service

Refunds

Except as defined elsewhere in this document, Pack Adventures bookings are nonrefundable. If Pack Adventures must cancel a session, clients will be notified—whenever possible—at least one hour in advance by phone or text. In that case, refunds or credits will be provided.

Road and Weather Conditions

Pack Adventures staff may cancel sessions if road or weather conditions are deemed unsafe. In such cases, clients will be informed at least one hour in advance via phone or text and will receive refunds or credits. If weather conditions change during an outing, staff will make every effort to still provide an enriching experience for your dog, but must prioritize safety. Hot or cold weather may be safe for some dogs and unsafe for others based on breed, body type, health, etc. Staff will use their best judgement, which may mean limiting your dog's exercise. While staff will make every effort to identify safe exertion and weather limitations, it is your responsibility to monitor weather and your own dog's limits, and to cancel or request accommodations if your dog can't safely be exercised under current conditions.

Illness and Emergency

If your dog must miss their booked session due to a veterinarian-confirmed injury or illness, or has been exposed to a communicable illness, you will be refunded for the missed session. Dogs who have or are suspected to have a communicable illness, including parasites, are not permitted on outings and will be refunded or offered a credit for their missed session if communicated in advance. If staff suspect that your dog may have a communicable illness at the time of your session, your dog will be excused without a refund. If your dog must miss their scheduled session because of a serious (human) medical emergency or other catastrophic event, you will be refunded or offered a credit for your missed session.

Aggression and Behavior

Dogs who show aggression toward other dogs are not ready for group settings, and will be excused without a refund. Dogs who show aggression toward staff members will be excused without a refund. All history of aggression or change in propensity toward aggression must be declared to Pack Adventures staff in a timely manner. Dogs who show unacceptable levels of stress, or cannot integrate into social groups, will be excused with a refund from any future sessions.

Photo Release

We sometimes take photos and videos during outings. Agreeing to these terms authorizes Pack Adventures to include you and your dog as the subject of photographs and/or audiovisual recording, and authorizes Pack Adventures to copyright, use, publish and/or post these above-described material(s) with or without your knowledge for educational or advertising purposes. If you do NOT want your or your dog's image taken, please notify us by email or text.

Mud/Dirt

Dogs sometimes get muddy/dirty during outings. While we will do our best to towel-dry your dog as a courtesy, dogs who become very dirty, have heavy coats, or are uncomfortable being toweled off may still be dirty upon dropoff. We are happy to return your dog to a confinement area or kennel upon request. If preapproved and in our service area, we can drop the dog off at their regular groomer's. In this case, you are responsible for all details, including making the appointment and picking your dog up afterward. We do not towel dry dogs who show aggression or fear toward our staff during body handling/toweling.

Pickup Window

While we make every effort to pick up and drop off dogs at the anticipated times, the variable nature of traffic means that pickup/dropoff windows are approximate. If we expect to be more than 15 minutes outside of our stated times, our team will do our best to notify you. If Pack Adventures staff will be entering your home to handle pickup, it is the owner's responsibility to make sure Pack Adventures has prompt access to a key, keypad, or other entry method. It is the owner's responsibility to ensure their dog is ready for prompt pickup. If the dog is not ready for pickup at the agreed-upon time, and cannot be made ready within 5 minutes, or staff cannot gain access to your home within 5 minutes of arrival, this will be considered a "no-show."
